These Terms and Conditions set forth below (“Terms”) govern the relationship between you, the passenger, and At Your Pace – Freestyle Cycling Adventures, LLC (hereinafter known as AYP, “we,” or “us”) and its owners, affiliates, officers, agents, representatives, successors and assigns with respect to any and all bookings, tours or transactions made with AYP. By completing the reservation form and signing these Terms, either by handwriting or electronic signature, you agree to be bound by these Terms and Conditions and direct us to perform services on your behalf. They outline, among other things, our cancellation policy and certain limitations of liability. These terms affect your rights to sue, governing law, forum, and jurisdiction; please be sure to carefully read these terms and make sure you understand your rights and obligations and our rights and obligations.
Multi-Day tours: A deposit of $350 USD per person is required ($750 USD per person for custom tours) at the time of your booking in order to secure a reservation. If you are paying via credit card, your credit card will be charged $350 USD per person ($750 USD per person for custom tours) once the entire tour itinerary is confirmed, typically within 1-3 business days.
If you must cancel your trip, or any component of your trip, you must do so in writing. Cancellation refunds will be calculated as of the date we receive your written cancellation. All payments for travel services not provided to you shall be refunded in accordance with these Terms and Conditions and in accordance with AYP’s cancellation policy.
There is a non-refundable fee of $150 USD per person for each multi-day tour you cancel. This low fee reflects only our costs of administering a reservation, and is not intended to be punitive in any way.
Refunds will be processed 30 days after our receipt of your written cancellation. Please note that if you cancel on or after the scheduled date of departure, you will not receive any refund.
Multi-day tours: For all cancellations we will refund the cost of your trip less the following per-person charges. Charges include the $150 processing fee.
Day tours: For all cancellations we will refund the cost of your trip less the following per-person charges. Charges include a 10% transaction fee.
There are no refunds made after the tour departure date or for no-shows. No refunds will be made for partial cancellation of tours or for late arrivals.
Traveler substitutions are considered reservation cancellations and are subject to the above cancellation charges.
AYP cannot make exceptions to these cancellation policies for any reason.
For any changes you make to your reservation that affect destination, departure date or pre or post tour extensions, a $100 USD per person administrative charge applies, in addition to any cancellation charges or applicable fees imposed by hotels. For changes made within 90 days of your original departure date, our cancellation policies apply. All changes are subject to availability and cannot be guaranteed.
We highly recommend that you purchase travel insurance prior to your departure to protect you from unexpected events, including flight cancellation, lost luggage, and unexpected medical expenses. Every effort has been made to produce pricing information accurately. We reserve the right to correct errors at any time or to increase prices if costs increase.
AYP reserves the right to make route and hotel modifications as needed. Every effort is made to operate tours as scheduled and to keep any changes to a minimum.
We reserve the right to cancel any tour prior to departure for any reason. Although rare, in the event of a cancellation, a full refund will be issued to you, which constitutes full settlement.
You will be notified of any changes in itinerary or with a supplier.
You must advise us in writing, at or prior to booking, of any physical, emotional or mental condition, which may require professional attention during the trip or may require the use of special equipment. You are solely and completely responsible for ascertaining and verifying that you are fit to participate in the requested cycling itinerary. If you fail to disclose any such conditions, AYP may refuse to allow you to take the trip and you will forfeit the trip cost; and in such event we shall have no liability, financial or otherwise. If you are so challenged, you must bring and be responsible for all necessary items related to your condition. If any such condition arises after the trip is booked, you must advise us in writing immediately.
Children are welcome to participate in our tours. A certified copy of a birth certificate must be produced for each child participating. Unless a child is traveling with at least one parent, a notarized letter written by a parent granting authorization to travel is required.
Bicycle rental is available for an additional per person charge on all tours. AYP has relationships with local bike rental shops, and can assist in the process if needed. Bikes are hybrid or road bikes. You are responsible for the bike once it is in your possession at the first hotel, and are responsible for any costs incurred for damage or theft, up to the full value of the bicycle. You may also bring your own bike on tour. Any customers who choose to bring their own bicycles are responsible for all mechanical issues and all transportation issues. Each self-guided tour includes Emergency Service. Examples of emergency service include broken down equipment (other than a flat tire) and minor injury/illness that prevents continued cycling (serious and/or life threatening injuries must be reported to 911). There is a local contact that is available by telephone. This service is available only during daylight cycling hours, and to be clear, AYP is not providing any EMT or paramedic services.
You should be in good health to participate in our active vacations. AYP is not responsible for the costs of any medical treatment you may require during the trip. Under no circumstances is AYP responsible for the quality of medical care, or lack thereof, you may receive while on the trip. We strongly recommend that you obtain medical and dental insurance that will cover the cost of any medical and dental assistance you may require during your trip.
You will receive tour documentation via e-mail after we receive your final payment. Tour documentation will include confirmations, travel information, a complete tour itinerary, and suggestions for preparing for your trip.
You are responsible for ensuring that all necessary travel documents are valid, effective and in your possession for the duration of the tour. You assume complete and full responsibility for checking and verifying any and all passport, visa and other entry requirements. You are solely responsible for any consequences as a result of missing or defective documentation.
Please check each tour description to ensure that you are familiar with tour inclusions. Tours do not include air, train or car transportation or reservations; airport, trip or medical insurance; excess baggage charges, or transfers to and from the starting/ending hotels. Meals, except for those mentioned in specific itineraries, are excluded, as well as any optional tour or sightseeing events. Unless otherwise noted, beverages are excluded.
The responsibility of AYP is strictly limited. As a tour operator, AYP organizes, promotes, and sells tour programs consisting of certain travel services, including surface and sightseeing excursions, and hotel accommodations that AYP purchases or reserves from various suppliers (collectively, “Suppliers”), including accommodations, meals, transportation, and activities. AYP does not own or operate any of these Suppliers. The Suppliers providing travel services for AYP’s tour programs are independent contractors and are not agents or employees of AYP. As such, AYP is not responsible for any negligent or willful act or failure to act of any Supplier or of any third party. A Supplier’s services are subject to the Supplier’s own Terms and Conditions and any local laws and regulations. By utilizing the travel services of the Suppliers, you agree that you will look to such Suppliers for any accident, injury, property damage, or personal loss to you or to those traveling with you, and that neither AYP nor any representative of AYP shall be liable.
The undersigned understands that bicycling on open roads is an activity that has certain risks and dangers, including the risk of serious bodily injury or death. As part of these terms and conditions, the undersigned waives any claim or right to sue under any theory in tort, including negligence, that he/she might otherwise have against AYP and the other parties referenced above.
Without limitation, AYP is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from – but not limited to – physical exertion; collisions with bicycles, pedestrians or automobiles; road conditions including but not limited to lack of shoulder and roadway surfaces; travel by plane, train, auto, or other conveyance, or by bicycle, horseback, foot, or other form of active or adventure travel; consumption of alcoholic beverages; high altitude; acts of God or force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation or for the failure of any transportation mechanism to arrive or depart on time, sanitation problems, lack of medical care, or for any other cause beyond the direct control of AYP.
AYP does not act as an agent for any party whatsoever. AYP reserves the right to correct promotional or pricing errors at any time, or to increase the program price in the event of cost increases due to changes in hotels, park fee increases, taxes, or fuel surcharges. Hotels and other accommodations are subject to change.
AYP is also not liable for: expenses (e.g., meals, transportation, or hotel costs) that are not specified as included in the trip cost but may be required to get to or from a trip start or end. AYP reserves the right to make route and hotel modifications as necessary to improve the quality of a trip or to accommodate the comfort and wellbeing of tour participants.
Tour participants grant AYP express permission to use photographs or film records of its trips for promotional and commercial use, without remuneration. Tour participants agree to assign all right, title and interest they may have in or to any media in which their name or likeness might be used to AYP. Tour participants also agree that AYP may use any testimonials regarding services rendered for promotional and/or commercial purposes without any remuneration.
AYP photography within this website is copyrighted and may not be reproduced without permission.
Information provided to us will be kept confidential and will not be sold or disclosed to third parties for any purpose beyond what is needed to secure your travel arrangements with our suppliers or as required by law. We do not retain any credit card information. Mailing and past travel information will be retained. You may receive mailings or emails from us periodically and may opt out at any time.
The laws of the State of Colorado shall govern this relationship. Any claims against AYP must be brought in the Federal or State Courts located in the State of Colorado, to the exclusion of the Courts of any other state and country.
AYP reserves the right to update these Terms & Conditions at any time. The latest Terms & Conditions can be found on the AYP website at www.atyourpacebiking.com.
